Eric Levinrad is a Partner in the Litigation Department.
Eric has extensive experience litigating high stakes disputes in state and federal court and in arbitration, and has substantial trial and appellate experience. His practice is focused on real estate litigation, as well as complex business litigation, probate litigation and intellectual property litigation, including trademark, copyright and trade secret cases.
Based on his excellent written and oral advocacy, creative approach to legal problems and sound judgment, he has obtained numerous victories for his clients, through trial, arbitration and alternative dispute resolution.
Representative Matters
- Property Claim: Successfully defeated claims to a 50% interest in a multi-unit apartment building and substantial damages, obtaining a complete defense verdict and cost award following trial.
- Claimed Breach of Software Development Agreement: Successfully represented software developer in claims alleging breaches of software development agreement, leading to favorable settlement and dismissal of claims.
- Encroachment: Successfully litigated claims of encroachment on high end residential real estate, defeating prescriptive easement claims through summary adjudication and obtaining favorable settlement terminating encroachment.
- Defamation and Tortious Interference: Defended claims of defamation and tortious interference, obtaining favorable settlement on the eve of trial after obtaining key third party witness declarations conclusively refuting plaintiff’s claims.
- Trust Litigation: Successfully represented trust beneficiaries in action involving significant trust assets, numerous contested issues and surcharge claims.
- Trade Secret Misappropriation: Asserted trade secret misappropriation claims against a group of employees who misappropriated client’s sensitive trade secret information. Successfully resolved case after securing “smoking gun” documents evidencing theft.
- Recovery of Precious Metal: Lead counsel in action brought on behalf of international precious metal company to secure recovery for theft of precious metal. Obtained favorable settlement of action for conversion and related claims.
