Insurance Coverage and Recovery
Overview
Insurance coverage is sometimes a hidden asset on a company’s balance sheet. In seeking to unlock that asset, ECJ’s Insurance Coverage and Recovery Department counsels businesses and individuals in assessing their existing insurance coverages and recovering for losses that may be covered under Comprehensive General Liability, Directors and Officers, and other types of policies. In addition, where coverage is accepted by an insurance company, we represent our clients in protecting and safeguarding their rights in connection with an insurance company’s handling of, or its funding the defense for, a particular matter.
Some of our group’s recent matters include:
- Seeking recovery for business interruption losses, particularly in the context of the ongoing Covid-19 pandemic;
- Pursuing the recovery of defense fees arising from a series of lawsuits that had been successfully resolved for a business client;
- Defending and prosecuting claims against and from carriers disputing coverage for business, construction and environmental matters;
- Representing a public company in connection with securing coverage under a Directors and Officers policy;
- Pending litigation involving the recovery of benefits under a life insurance policy following declination by the insurance company; and
- Assessing coverage for claims involving environmental contamination and alleged pollution, including insurance archaeology and coverage for claims involving alleged contamination occurring as much as 30 to 40 years ago.
