State Regulators Also Use Receivers: When, Why and How | National Association of Federal Equity Receivers Conference
This session discussed the use of receivers in enforcement actions brought by state regulators. The panel highlighted the various state laws they regulate, where receivership remedies are used, as well as other agencies in their state that also use receiverships. They discussed coordination with the CFTC, SEC, and FTC, other state regulators, as well as criminal authorities. Peter Davidson from ECJ, along with four other industry professionals, participated in the discussion, explaining when and why they might have used lesser remedies; what they looked for in deciding who to nominate as receiver; and any special state laws that vested receivers with special powers and rights, regulated reporting requirements, and outlined how receivers were paid, among other issues particular to state enforcement receiverships.
